Friedland Law is seeking an experienced Personal Injury & Medical Malpractice Litigation Attorney with a minimum of five years of litigation experience, including substantial medical malpractice experience, to independently manage a full litigation caseload from file transfer through trial or resolution.
Key Responsibilities
- Independently manage personal injury and medical malpractice litigation matters from case transfer through settlement, resolution, or trial
- Conduct initial client contact upon transfer of cases into litigation and maintain consistent communication throughout the litigation process
- Handle medical malpractice pre-suit requirements and procedures, including drafting and serving Notices of Intent (NOIs)
- Draft, file, and amend complaints and other pleadings
- Draft and respond to written discovery, including interrogatories, requests for production, and requests for admission
- Draft and respond to motions, including dispositive motions and motions for summary judgment
- Conduct legal research and prepare legal memoranda
- Analyze medical records, damages, liability issues, and other evidence relevant to personal injury and medical malpractice claims
- Prepare clients for depositions, mediations, settlement conferences, arbitrations, hearings, and trial
- Take and defend depositions, including depositions involving parties, fact witnesses, medical providers, and experts
- Attend mediations, settlement conferences, arbitrations, hearings, and other court proceedings
- Negotiate settlements and aggressively advocate for favorable case resolutions
- Draft proposals for settlement and review settlement statements
- Communicate and negotiate with opposing counsel regarding case issues, settlements, discovery disputes, and agreed orders
- Negotiate and dispute attorney liens when necessary
- Prepare medical chronologies when law clerk or other support is unavailable
- Conduct regular case reviews with paralegals and support staff to ensure deadlines, discovery, case strategy, and client needs are properly managed
- Develop litigation and trial strategy for assigned cases
- Prepare cases for trial, including witness preparation, jury instructions, verdict forms, motions in limine, exhibits, and other trial materials
- Prepare for and attend jury trials
- Independently manage deadlines and a high-volume caseload while maintaining strong attention to detail
Required Qualifications
- Juris Doctor (JD) from an accredited law school
- Active license and good standing with the Florida Bar
- Minimum 5 years of personal injury litigation experience
- Minimum 5 years of medical malpractice litigation experience
- Strong knowledge of Florida medical malpractice litigation, including applicable pre-suit requirements and procedures
- Proven ability to independently manage personal injury and medical malpractice cases through litigation, settlement, resolution, and trial
- Significant experience with pleadings, written discovery, depositions, motion practice, mediations, and court hearings
- Strong legal research and legal writing skills
- Strong oral advocacy, negotiation, and courtroom skills
- Ability to analyze complex medical records, medical issues, damages, and liability
- Ability to effectively manage a high-volume litigation caseload and competing deadlines
- Excellent client communication skills
- Ability to work independently while collaborating effectively with paralegals, law clerks, and other support staff
Preferred Skills & Experience
- Jury trial experience
- Extensive courtroom and deposition experience
- Experience handling complex and high-value personal injury and medical malpractice cases
- Experience working with medical experts and expert witnesses
- Experience negotiating and disputing attorney liens
- Strong familiarity with medical records, medical chronologies, causation issues, and damages analysis
- Demonstrated ability to develop case strategy and evaluate cases for settlement versus trial
- Strong leadership and case-management skills
